Australian citizenship

Australia allows dual citizenship, but India does not: an Indian citizen who voluntarily becomes an Australian citizen automatically loses Indian citizenship under section 9 of the Citizenship Act, 1955, and must surrender the Indian passport (High Commission of India).

The core requirement

arrow
  • Residence: lawfully living in Australia on a valid visa for the 4 years immediately before applying, including the last 12 months as a permanent resident, with no more than 12 months' absence in the 4 years and no more than 90 days in the final 12 months (Home Affairs residence calculator). Time on student and 485 visas counts toward the 4 years.
  • Fee: AUD 595 for a standard adult conferral application from 1 July 2026, per Schedule 3 of the Australian Citizenship Regulation 2016 as indexed (Home Affairs citizenship).
  • Test: applicants aged 18-59 generally sit the citizenship test (20 questions, 75% pass mark, all five Australian-values questions correct) (Home Affairs).

Realistic timeline from student visa to citizenship

arrow

No official student-to-citizenship timeline exists. Build your own from these fixed rules:

You become eligible on the later of two dates: when you reach 4 years of lawful residence, or 12 months after your PR is granted (Home Affairs residence calculator).

Example: a 2-year Master's followed by a 485 means you reach 4 years' residence during the 485, but you still need 12 months as a PR. The real driver is when you obtain PR, which depends on your occupation, points, nomination or employer - none of which is guaranteed. Home Affairs publishes current citizenship processing times; check them when you are close to applying.

What Australian citizenship gives you

arrow
  • An Australian passport, the right to vote (compulsory for citizens), and unrestricted residence and work rights.
  • Dual citizenship: Indian nationals cannot hold both. Australia permits dual citizenship, but India's Citizenship Act does not; acquiring Australian citizenship ends Indian citizenship automatically (High Commission of India, Kampala; Consulate General of India, Munich).

Citizenship test and application process

arrow
  1. Check eligibility with the Home Affairs residence calculator.
  2. Gather identity documents, residence evidence and character information (police certificates from countries you lived in, if requested).
  3. Apply online and pay the fee.
  4. Sit the test and attend an interview if required.
  5. Receive the decision.
  6. Attend a citizenship ceremony and make the pledge; citizenship takes effect at the ceremony.

Indian citizenship and Australian naturalisation

arrow
  • On becoming Australian, you must surrender your Indian passport to an Indian mission and obtain a Surrender Certificate; holding or using an Indian passport after acquiring foreign citizenship is an offence under the Passports Act, 1967 (Consulate General of India, Munich).
  • OCI: former Indian citizens can apply for Overseas Citizenship of India, a lifelong multiple-entry status with rights to live and work in India, but not to vote or hold certain public offices. A Surrender Certificate is required for the OCI application.
  • Plan the timing: travel to India between naturalisation and OCI grant needs an Indian visa.

Tax and financial considerations after PR/citizenship

arrow
  • Australian tax residency is based on residence tests, not visa type; Australian residents are taxed on worldwide income.
  • Superannuation: temporary residents who leave can claim their super as a Departing Australia Superannuation Payment (taxed); PRs and citizens generally access super only at preservation age.
  • Indian assets (property, NRO/NRE accounts, investments) have reporting and tax implications in both countries under the India-Australia double tax agreement.
  • Get advice from a tax professional for your situation.

Return-to-India or long-term Australia decision

arrow
  • Citizenship does not require you to stay in Australia; PR has a 5-year travel facility, after which a Resident Return Visa may be needed (Home Affairs).
  • Weigh OCI rights against losing Indian citizenship before applying; many Indian-origin PRs choose to stay PR for this reason.

Returning to India after PR: practical steps

arrow
  • Citizenship: as a PR you are still an Indian citizen, so returning needs no Indian visa or OCI.
  • Keeping PR: a permanent visa's travel facility generally lasts 5 years from grant; after it expires you need a Resident Return Visa to re-enter as a permanent resident, which requires ties to or recent residence in Australia (Home Affairs).
  • Superannuation: the Departing Australia Superannuation Payment is only for temporary visa holders. PRs and citizens generally cannot withdraw super until preservation age (ATO).
  • Tax: leaving usually changes your Australian tax residency; tell the ATO and your bank, and get advice under the India-Australia tax treaty for income, property and investments in both countries.
  • Practical: close or keep bank accounts and credit, settle leases and bonds, and keep records of your Australian residence in case you later want to return or apply for citizenship.
