If your H1B visa application is delayed or rejected, your next steps depend on the situation:

- Delayed (Administrative Processing): You may be asked for more documents or information. You have up to one year from the refusal date to submit what’s needed without starting over.
- Rejected/Denied: The denial letter will state the reason. You can appeal by filing a Motion to Reopen or Motion to Reconsider within 30 days, or you may file a new petition - but if your previous petition was cap-subject (lottery), you cannot reapply for the same fiscal year.
