What is the Full form of BIFR?

BIFR stands for the Board of Industrial and Financial Reconstruction. It was a Government of India institution and a branch of the Ministry of Finance’s Department of Financial Services, established under the Sick Industrial Companies Act (SICA) of 1985. Its goal was to remodel and recover sick ventures while also preventing sick performances from growing or occurring in the future or in the long term.

Objectives of BIFR

  • The BIFR is made up of a chairperson and two to fourteen other representatives.
  • The requirement for all members to be chosen as High Court judges is that they have at least 15 years of essential professional experience.
  • Only large or medium-sized sick industrial businesses where massive quantities have been destroyed are organised and overseen by the Board.

History of BIFR

  • Industrial illness first appeared in India before to independence. In the early days, the Indian government attempted to address it with ad-hoc measures involving the nationalisation of banks to provide interim help.
  • The Tandon committee was established by the RBI in 1975. After one year, the HN Ray Committee was organised and established. These committees’ recommendations were insufficiently effective and required.
  • In 1981, the Tiwari Committee was formed, and it advocated broad-based legislation to address workplace disease. As a result, SICA was established in 1985, and BIFR was established within SICA in January 1987.
  • The Appellate Authority for Industrial and Financial Reconstruction (AAIFR) was established in April 1987.
  • Government firms were established in 1991 under the authority of SICA. Following that, both public and private organisations with cases of occupational illness were included.
  • The Amendment Bill was introduced in 2001 as the government thought that the BIFR was not achieving its goals of preventing industrial illnesses.
  • The Repeal Act on Sick Industrial Companies was passed in 2003, retaking the position of SICA and allowing BIFR and AAIFR to occur with the NCLT (National Company Law Tribunal) as well as the NCLAT (National Company Law Tribunal) (National Company Law Appellate Tribunal).
